The Wenchi High Court presided over by Justice Frederick Arnold W.K Nawurah yesterday threw out the petition against the Techiman South parliamentary election filed by the National Democratic Congress (NDC).
The court also fined the petitioners GH¢ 100,000.00 to be shared between the member of parliament of the constituency and the Electoral Commission (EC).
The election petition was filed by the opposition NDC in respect of the 2020 parliamentary elections in the Techiman South Constituency which resulted in the death of eight people in the 2020 General Elections.
Reacting to the dismissal of the case, a member of the opposition NDC legal team, Lawyer Abraham Amalibah said, the verdict of the court contradicts the reality because the electoral commission agreed on bloating figures but the judge refused to comment on the bloated figures.
He said there were two pieces of evidence the judge could have built the case upon.
“There were two testimonies or evidence competing that the case could have been built on, the returning officer didn't do the coalition but in the witness box, he said there was a coalition. the regional director of elections for Bono East said in the witness box that there was no coalition other than that he wouldn't have told the returning officer to create a coalition however the judge said he believe what the returning officer said more than the regional director of the EC who is an independent person,” He said.
He told Omanhene on Sompa Tv the party is not happy about the presiding judge’s decision not to admit some of the clear evidence of abnormalities in some polling stations during the elections.
“At least he should have recognized these discrepancies and said we should move on, it could have been better than not acknowledging the abnormalities, he concluded.
Meanwhile,
The NDC had said that it won the Techiman South parliamentary election but claimed that the EC and the New Patriotic Party (NPP) connived to deny it the seat.
But the EC insisted Martin Adjei Mensah Korsah, Member of Parliament for the Techiman South Constituency polled 49,682 votes as against 49,205 votes for Christopher Beyere for the NDC.
