The Asokwa Circuit Court has remanded the Suame Constituency Youth organizer of the National Democratic Congress, Razak Koampa Avoliya over shoot to kill comment’ which should have been heard by the District Court 4 as reported earlier by Sompa Tv.
The Court declined the request for bail by the Counsel of the accused person and insists the matter bothers on National Security.
Razak Avoliya was arrested, charged and detained on Wednesday after party executives turned him over to the police.
Razak was seen in a viral video urging NDC supporter to unleash mayhem on members of the New Patriotic Party during the run-up to the 2024 elections.
Party supporters in the Ashanti Region earlier today gathered at the Asokwa District Court to witness the court appearance of the party’s embattled Youth Organizer in the Suame Constituency.
The court presided over by His Honor Fred Obikyere adjourned the case to 14th February 2023 however Razak is to be kept in the police custody until then.
Evans Amankwaah, the accused person's lawyer claims that neither his client nor the party is perturbed by the detention.
“They charged him with offensive conduct. We will cooperate with the law. The detention does not perturb us.
He is not worried, and I assure the supporters of the NDC that, the youth organizer is in high spirits,”
"I insisted my client got bail, but the prosecution said the plea of the accused person can't be granted since his said video is now going to be transcribed to English before any further judgment, because my client I know will not in any way interfere in the investigation or transcribing of the video but which in my opinion I disagree with the court's decision, but." Lawyer Amankwah said.
Lawyer Amankwa therefore bemoaned the decision of the court and suggested that the Ghana Police Service should build more cells.
Meanwhile
The Asokwa Circuit presided over by his honour Fred Obikyere has remanded the accused Razak Koampa, youth organizer of Suame NDC constituency to police custody.
The accused will reappear before the court on Tuesday February 14, 2023.
The NDC youth organizer was charged with offensive conduct, Conducive of the peace as stated in section 207 of criminal offense act 29.
The lawyer for the accused Evans Amankwaa pleaded the court to grant the accused bail since the accused voluntary gave himself to the police in good faith.
The lawyer further indicated that the police have misrepresented the content of the tape, and the accused has men of substance who qualify to grant him bail including the lawyer himself.
However the Prosecutor ACP Kofi Blagodzi insisted that the statement of the accused is grievous hence the court should deny the request of the lawyer.
The judge, his honor Fred Obikyere underscored in his ruling, that inasmuch the accused made a voluntary arrest, his statement contain serious implications on national security, hence the accused should be remanded till next week Tuesday.
The counselor of the accused in an interview with Sompa FM's Bawah Baidoo after the ruling expressed worry of the outcome and asked interior Minister to build more cells if that is the way the government has planned to deprive the freedom of expression to well-meaning Ghanaians especially the NDC.
