Former Minister of Youth and Sports, Dr Mustapha Ahmed, has been sentenced to seven days imprisonment and fined GH¢12,000 by the Accra High Court (Financial and Economic Crime Division 2) for contempt of court.
The sentence was issued after the former minister violated a perpetual injunction granted by the court in June 2019, which restrained him from trespassing on land.
Dr Ahmed was also ordered to pay GH¢5,000 of the fine to Kofi Ammoah Kwafo, the man who initiated the contempt application against him, the Chief of Defence Staff, and the Director-General of Logistics of the Ghana Armed Forces (GAF).
The contempt motion originated from a land litigation case that occurred six years ago. Dr Ahmed had sold land to Mr Kwafo in the year 2000 but later repossessed it, claiming to have made a mistake.
The contempt application was initiated by Mr Kwafo, who alleged that the officers of the GAF occupying a property built on the disputed land had resisted the execution of the court’s judgment.
Justice Afia Serwah Asare-Botwe, who presided over the case, noted that both the Chief of Defence Staff and the Director-General of Logistics were not personally served with copies of the court land litigation judgement of 2019.
However, Mr Kwafo argued that the officers of the GAF were in contempt of court when they resisted the execution of the court’s judgement. Dr Ahmed’s counsel denied the allegations, stating that his client had not breached any court order or judgement.
