Dr. Eric Oduro Osae, a legal practitioner has called for a total re-writing of the 1992 constitution of Ghana, saying, "review would not be the solution to the nation's problem."
Dr. Oduro Osae explained the constitution which came to place during the political instability period of the country has outlived its usefulness hence the need to rewrite it into a development constitution.
The former Justice of the Supreme Court of Ghana, William Atuguba speaking during a public lecture and a panel discussion held at the University of Ghana yesterday called for an immediate review of the Ghanaian constitution, describing it as flawed.
The Director-General of the Internal Audit Agency (IAA) commenting on Justice Atuguba’s (Rtd) comments in an interview with Nana Kwame Owusu Nkwantabisa, host of Sompa Ade Akye Abiaa show in Sunyani indicated that a total rewriting of the constitution would enable the country to change some entrenched provisions.
“Even though we want to develop, our current constitution is a stability constitution that has moved us from military government to a constitutionally elected government; that stability we have we’ve gotten it, now we have to move towards development”, he stressed.
According to Dr Osae, majority of the recommendations of the constitutional review commission bordered on the review of the entrenched provisions and clauses.
“The rewriting of the constitution would offer Ghanaians the opportunity to amend the constitution to reflect their development aspirations.”
According to him, a new constitution would help to make certain changes such as reducing the number of ministers appointed from Parliament, saying, “It doesn’t help in the check and balance we needed to make our democracy rich.”
