Mr. William Kusi Esq, a private legal practitioner with dominion chambers in Kumasi has thrown shades at the former president, John Dramani Mahama describing his comment on the judiciary as immature and unfortunate.
According to him, the former president had the opportunity to also appoint judges onto the Supreme Court with the same factors and procedures as ascribed by the 1992 constitution; however he cannot understand why the former president would make such public outburst, a statement he describes as childish on the part of the former president.
“John Mahama has been a president before, he also benefited from the judgment of these judges at the Supreme Court during the 2012 election petition by the NPP. In fact, he appeared before the same judges and won the suit, in law school, we called it second re-akoto and so you wonder where he is coming from and why he keeps making such statements to undermine the judiciary, even if it is a truism you don’t politicize the judiciary, he said.
He said the current chief justice has a mandate and longevity to serve, even though his days in office are almost due and that is the natural way of exiting them from office.
“When you are a statesman, you are careful with what you say, you should know the harm you are causing the country if you drag the judiciary into politics. Not every decision by the court may seem favorable to everyone, even we the lawyers and the politicians too, it didn’t start today, it has been there since regimes so you presume that is how the law works, the Chief Justice retires at age 70, that is the natural way of exiting them from office, he maintained.
He continued by saying “such statement is an attack on the judiciary and described it as an immature.
Mr kusi called on the former president to apologize and redraw his statement which has the tendency of jeopardizing the integrity of the judicial system.
’People have had issues with court rulings, yet they kept quiet, in as much as you may have a genuine concern, you shouldn’t personalized it to make issues out of it, he should apologize.
He maintained that the NDC failed to present facts and accurate figures before the court and shouldn’t expect a favorable ruling.
“even class one lawyer will decide against the 2020 election petition they filed, why would you go to court and don’t have a concrete evidence, you don’t expect the court to rule in your favor, I mean this is childish, the responsibility of the lawyer who goes to court is to present evidence, the judge there is supposed to be ignorant of whatever that happened, he determines the matter based on the information you provide, he stated.
He made these statements on Sompa Fm ‘Me Man Nti’ in Kumasi during a panel discussion with Yaw Boama.
